HOA & Condo Election Law by State

Whether your association can vote online, and exactly what has to be true for that vote to hold up, comes down to state law – not your bylaws, not your voting platform, and not what a neighboring community does. Some states require a formal board resolution and each owner’s written consent before electronic voting is allowed at all. Others fold it into a broader “use of technology” statute with no separate consent step. A couple of states don’t have a dedicated online-voting law at all, just older ballot-delivery rules that happen to allow it. None of that is a guess on our part – find your state below for what its statute actually says, and how Vote HOA Now’s platform is built to meet it.

Two Questions Worth Answering Directly

Boards and management companies evaluating a vendor tend to ask two different things, and they deserve two different answers. First: does the platform itself conform to our state’s election law, or could using it become the reason a result gets challenged? Second: has this company actually run elections here before, or would we be the first? Every state page below answers both.

Find Your State

Florida – board resolution plus written owner consent, under two separate statutes for HOAs and condos.

Virginia – electronic voting is allowed by default unless your declaration expressly says otherwise.

Maryland – the board may authorize electronic voting on its own, and can retain a third-party vendor to satisfy the state’s independent-party election requirement.

New Jersey – board decision plus individual owner consent, under the Radburn Act’s election-reform provisions.

Texas – HOAs vote by electronic ballot with no board resolution required; condos vote electronically through a separate, newer statute tied to remote-meeting participation.

Arizona – the real online-voting rules live in the Nonprofit Corporation Act, not the community-association statute – most HOAs and condos are incorporated under both.

Illinois – A broad “use of technology” statute covers votes, notices, and signatures alike.
